GENERAL PROVISIONS
- The website green-hood.eu functions according to the rules specified in these Terms and Conditions. The Terms and Conditions specify the kinds and scope of services performed electronically by the Website green-hood.eu, the rules of performing these services, the conditions of concluding and terminating the contracts about performing services electronically, as well as the complaint proceedings.
- The Terms and Conditions specify the kinds and the scope of the services provided electronically by the Website green-hood.eu, the rules of performing these services, the conditions of concluding and terminating the contracts about performing the services electronically, as well as the complaint proceedings.
- At the moment of beginning the activities with the purpose of using the electronic services of the Website green-hood.eu, every Customer is obliged to observe the provisions of these Terms and Conditions.
- In the cases which are not regulated by these Terms and Conditions, the regulations of the law on performing services electronically from the 18 July 2002 shall apply (OJ No. 44, pos. 1204 with amendments),
- Law on consumer rights from the 30 May 2014 (OJ 2014, pod. 827),
- Law Civil Code from the 23 April 1964 (OJ No. 16, pos. 93 with amendments) and other corresponding regulations of the Polish law.
DEFINITIONS
- CONTACT FORM – The form available on the Website green-hood.eu, enabling the Customer a direct contact to the Service Provider.
- TERMS AND CONDITIONS – the terms and conditions of this Website
- SERVICE PROVIDER – e-mail address: contact@green-hood.eu
- CUSTOMER – natural person, legal person or organisational unit without legal personality, to whom the law grants the legal ability to use the Electronic Service
- ELECTRONIC SERVICE – a service provided electronically by the Service Provider towards the Customer by means of the Website
- NEWSLETTER – An Electronic Service enabling the Customer to subscribe and receive free information originating from the Service Provider on the e-mail address given by the Customer
TYPE AND SCOPE OF ELECTRONIC SERVICES
- The Service Provider enables using the Electronic Services by means of the Website. These Service are:
- using the Contact Form,
- using the Newsletter,
- providing Electronic Services towards the Customers is governed by terms specified in these Terms and Conditions.
TERMS OF PROVIDING SERVICES AND CONCLUDING CONTRACTS ON PROVIDING ELECTRONIC SERVICES
- Providing Electronic Services specified in the Chapter III point 1 of the Terms and Conditions by the Service Provider is free of charge.
- The term the contract is concluded:
- A contract on provision of an Electronic Service consisting in enabling the sending of the message by means of the Contact Form is concluded for a fixed period and is terminated as soon as the message is sent or cancelled by the Customer.
- A contract on provision of an Electronic Service consisting in using the Newsletter is concluded for an indefinite period.
- Technical requirements necessary to cooperate with the telecommunication system the Service Provider uses:
- computer with Internet access,
- access to the electronic mail,
- web browser,
- enabling Cookies and Javascript in the browser.
- The Customer is obliged to use the Website in accordance with the law and good conduct, having regard to the respect for personal rights and copyright and intellectual property of the third persons.
- The Customer is obliged to enter the data consistent with the actual state of affairs.
- The Customer is not allowed to distribute illegal content.
TERMS OF THE TERMINATION OF CONTRACTS ON PROVIDING ELECTRONIC SERVICES
- Termination of the contract on providing Electronic Services:
- A contract on providing continuous and indefinite Electronic Services (e.g. using the Newsletter) can be terminated.
- The Customer can terminate the contract with immediate effect and without the necessity to give the reasons by sending an appropriate statement by means of the electronic mail to the address: contact@green-hood.eu
- The Service Provider can terminate the contract on providing a continuous and indefinite Electronic Service, if the Customer violates the Terms and Conditions, especially if they distribute illegal content after an unsuccessful prior call to cease the violation and setting a corresponding term. In this case, the contract expires after 7 days after submitting the declaration of will about the termination (notice period).
- The termination leads to a cessation of legal relations with the effect for the future.
- The Service Provider and the Customer can terminate the contract on the provision of an Electronic Service at any time by common agreement.
COMPLAINT PROCEEDINGS
- Complaints regarding the provision of Electronic Services by the Service Provider:
- Complaints regarding the provision of Electronic Serviced on the Website can be submitted by the Customer via e-mail to: contact@green-hood.eu
- In the above-mentioned e-mail message a maximum of information and circumstances regarding the subject matter of the complaint should be given, especially the type and date of arising of irregularities and the contact data. The given information will significantly simplify and accelerate the consideration of the complaint by the Service Provider.
- The consideration of the complaint by the Service Provider succeeds immediately, not later than within 14 days.
- The Service Provider’s answer regarding the complaint is sent to the Customer’s e-mail address given in the complaint form or in other way given by the Customer.
INTELLECTUAL PROPERTY
- All contents placed on the website with the address green-hood.eu are protected by the copyright law and are property of green-hood.eu. The Customer is fully responsible for damage caused to the Service Provider that is caused by usage of any content of the website green-hood.eu without the Service Provider’s consent.
- Any usage of any elements building the content of the website green-hood.eu by any person is a copyright infringement given to the Service Provider and results in civil and criminal liability.
FINAL PROVISIONS
- The contracts concluded via Website are concluded according to the Polish law.
- If any part of the Terms and Conditions does not correspond to the applying law, corresponding regulations of the Polish law shall apply instead of the provision in question.
